ThedefaultprocedureinSamoa'scriminaljusticesystemisthataconvictwithtwosentencesmustservethemconcurrentlyandnotconsecutively. TheerrorwasspottedrecentlybyajudgewhenMrAgafiliappearedincourtonanothercharge.
InaninterviewwiththeSamoaObservernewspaper, Agafilidescribedhisanguishatspendingtoolongbehindbars. Hesaid: "It'sbrokenmeintoamillionpieces. Noonetoldmewhenmyjailtermwouldend. Ilostcountofthedays. Idon'tremembermuchaboutwhenIshouldbeout. IjustknowIhadtoservemytimebehindbars." MrAgafili'slawyerMurielLuispoketoreportersabouttheinjusticesufferedbyherclient. Shesaid: "He'sbeenimprisonedunlawfully. I'veheardofothercasesofasimilarnature. Thisisnotthefirstofthistype." Sheadded: "Hisrighttolibertyhasdefinitelybeenbreached." MsLuisaidthatshewouldbeseekingcompensationforherclient.
