Somepeoplebelievethatthereshouldbefixedpunishmentforeachtypeofcrime. Others, however, arguethatthecircumstancesofanindividualcrime, andthemotivationforcommittingit, shouldalwaysbetakenintoaccountwhendecidingonthepunishment. Discussboththeseviewsandgiveyourownopinion.
Fixingpunishmentsforeachtypeofcrimehasbeenadebatableissue. Therearemanyargumentssupportingbothviews, thoseforandthoseagainstfixedpunishments.
Ontheonehand, fixedpunishmentswillhaveadeterringeffectonsociety. Individualsknowingthattheywillbesubjecttoacertainpunishmentiftheyareconvictedwithagivencrime, willreconsidercommittingthisactinthefirstplace. Thisdeterringeffectalsoleadstosocialstabilityandsecurity, throughminimizingthenumberofcrimecommitted. Ifpeopleknewtheywouldbeabletoconvincethecourtorthejuryofareasonforhavingcommittedthecrimetheyareaccusedof, penaldecisionswouldbelargelyarbitrary. Thiswouldresultintocriminalsgettingawaywiththeircrimesandintoahighlevelofinjusticecausedbythesubjectiveapproachofdifferentcourts.
Ontheotherhand, takingthecircumstancesofacrimeanditsmotivationintoconsiderationisaprerequisiteforestablishingandensuringjusticeandequity. Apersonkillinginself-defensecannotbecomparedtoaserialkiller, movingfromonevictimtothenext.
